RE: Images of War

Anyway, Ashley, good to hear from you again, how goes things?
In answer to your question, yes there are many different claims to that particular pic, mainly because so many where done very similar during WWII, this one gave no squadron but did get a few details, “A lancaster bomber, one of the most popular during WWII, this one about to begin a flight to France during 1943, taken as the ground crew warmed up the plane before the Flight crew got in.” Apparently it was taken from a group in Hendon that converted over from Wellingtons, does that sound right?

RE: Images of War

“1. To be in breech of copyright, you must have copied at least 10% of the entire book, this quallifies the owner to sue for misuse and claim loyalties for which they are entitled to.”

Wrong. You must have copied one image, or part of text. To photocopy more than 10% of a book for private use, then you are correct. You have, by the nature of putting something you have copied into a public place, broken the law. I suggest that you consult the 1988 Patents, Designs and copyrights act.

“2. As the pics are very common, one could say that they came from anywhere, they are freely available on the net as well as the book I got them from, so copyright doesn’t really apply here.”

Wrong. You copied them from a book. Apart from breeching the copyrights of the author / publisher, you have also breached Crown Copyright on some of these. That’s sounds like treason you fifth columnist you. Amount of times published does not remove copyright from the copyright holder. I suggest that you consult the 1988 Patents, Designs and copyrights act.

And before anyone jumps in with the 50 year rule, the images have come from a book – so we have infringement there if not on the originating photographer. Tricky subject. Thats why Boots get sued so often. Take it from a photographer who was threatened with being sued on monday for something that the act showed me to be in the right about all along.

RE: Images of War

Of course there are WW2 pilots alive, i’ve met a few, they are in their eighties most of them but still have good stories to tell.

That pic of the He111 over the Thames is a very common one, almost any book on the Battle of Britian will have that photo in it.

That pic of the Lanc being run up at night is quite impressive, i have a similar one in one of my books but it is a Ju88 instead of a lanc.

Very enigmatic.

Is it a microdot, or are you just bringing the topic to a close?

RE: Images of War

Hi Ashley 🙂
That night time Lanc pic I think is an original rather than a modern posed or doctored shot.I’ve seen it in a few publications but none of them give any specific detail as to the particular aircraft, squadron, location etc,so she’s a bit of a mystery. One caption says that the aircraft is being illuminated by the take off clearance signal flashlight from the runway control van,but this seems unlikely as the wheel chocks and access ladder are still in place.
Sorry I can’t give you anymore info than that.

RE: Images of War

Hey Ja 🙂

That night time Lanc shot rings bells with me…it looks like a shot used in recent years in an advert for the RAF Benevolent Fund…I’ve always thought it was a black and white pic of the BBMF’s Lanc or Just Jane…maybe I was wrong! Any further details on the picture?

RE: Images of War

[updated:LAST EDITED ON 03-09-02 AT 12:39 PM (GMT)]DOUGHNUT: I was just sharing these pics of interest! As for the copyright, I’m not in breech here is why:

1. To be in breech of copyright, you must have copied at least 10% of the entire book, this quallifies the owner to sue for misuse and claim loyalties for which they are entitled to.

2. As the pics are very common, one could say that they came from anywhere, they are freely available on the net as well as the book I got them from, so copyright doesn’t really apply here.

Now is anyone prepared to discuss something of interest here or not?

Personally I find the B-29 pic very interesting.

RE: Images of War

To Ja Worsley,

Exactly what point are you trying to make with these photos ?

P.S. are you aware that you may be in breach of copyright by scanning and distributing them ?
