In Texas it states by law that during the open season, no person may take oysters from public water during the period between sunset and sunrise.

Sometimes there are reasons for dumb laws. Dumb reasons sometimes, but reasons never the less.
Texas has some really interesting laws, my personal favorite is the: “He needed killing law.” This is a principle were a defendant can claim that the victim was so nasty, he deserved to die.
The restriction on taking shellfish at night is probably to insure that Texas fishermen do not work overtime.
Another dumb law is that you can not buy a car in Detroit (car capitol of the world) on the weekend. this is to insure that car dealers get the weekend off.
