Tempest JN765

Hi,Can anyone tell me what happened to the remains of Tempest JN765 which crashed in Sussex on July 1 1944 and was recovered in,I believe 1995? I understand one of those involved in the recovery was later found guilty of digging the site illegally but were those involved in the dig allowed to keep the wreckage afterwards?

Probably because this was a very well-photographed (and filmed) aeroplane with excellent references for replicating it in model form. Equally, it has been the subject of one or two colour profiles. I suspect that is the reason – although you would have to ask the manufacturers.

I would echo Air Ministry’s sentiments but add the following comments.

It is old history, but a matter that certain individuals seem very keen to raise at regular intervals. Those individuals only seem to have recently discovered this story. The motives are clear. I suspect that the agenda of Dracus follows suit.

Unlike Dracus who hides his real name I have nothing to hide. The fact of the matter is that it was I who I pleaded guilty to recovering the Tempest in question without a current licence. The facts of the matter are that, quite simply, the MOD granted a licence to recover the Tempest and notified the landowner accordingly that a licence “had been granted.” The recovery later went ahead but many years later I was prosecuted for not having a licence. In fact, the MOD had issued (we believe in error) a licence that had been post dated by one month. We suspect this was a clerical error, since no other licence has ever been issued by the MOD that has been post dated. Ultimately, however, this was what was called an absolute offence – ie you either have a licence or you dont. Technically, I didn’t have a current licence although hadn’t realised it at the time. So, to spoil Dracus’ inference, I was not “found guilty” as he suggests. I pleaded guilty to a minor offence. Rather different than being “found guilty” – although perhaps Dracus is just misinformed unless he wants it to sound rather more dramatic than was the case.

In a nutshell, I got a slapped wrist but the “other” issues that had been raised were proven false and His Honour Judge Rennie branded the chief witness a liar who “….has lied to this court and to another.” The result? The MOD were ordered to pay my hugely subtantial costs and did so in full. Various news media organisations also paid very substantial damages to me in out of court settlements and published apologies.

I feel obliged to post the foregoing since I can see and sense where this is headed. This is now a regular old-chestnut dragged up on just about every forum out there.

So, unlike Dracus who hides his real identity I have nothing to hide.

As to the items in the Eastbourne auction, I had already notified the MOD direct on this matter as soon as it came to my attention. I have no doubt they will wish to identify the vendor and the source and I will be very happy to assist the MOD should they wish to pursue it although I realise that this may well spoil the fun for Dracus.

I just wanted to put things on record here. The pattern is all too familiar, I’m afraid.

Dracus, reading your 4 posts on this forum since you joined in February, I gain the impression that you are unusually interested in the subject of artifacts excavated, then sold on the net.
