Thought this would be of interest as it clarifies the regulatory position of “information” gathered by the 3 AIBs. I wonder if the MOU has come about following the Shoreham tragedy and the likely difficulty the media/public had in understanding the AAIBs position in the investigation. I recall this was discussed on a thread on here to understand why it was necessary for the police to make it’s own investigation without direct access to the evidence obtained by the AAIB which, by regulation, is confidential. In high profile cases, to illustrate to the media/public, the police have the option of applying through the courts for AIB information to be made available. The Judge then decides whether to make the information available or not. The presumption is “not” but has then been tested publicly in law for media/public consumption as was the case relating to Shoreham.
