ANGRY scenes erupted in a Perth court today as the family of two-year-old Tyrell Hart faced the man accused of murdering him in a road rage attack.
Members of the dead child’s family shouted abuse and had to be restrained by security staff in the Court of Petty Sessions as Neil Warren Brown made a brief appearance.
The charge against Brown, a 40-year-old Beckenham resident, was upgraded this morning from grievous bodily harm to murder.
Police will allege Tyrell died in the yard of his family home in Mills Street, Bentley, on March 5 after being crushed between the car he had just got out of and a second vehicle that accelerated up the driveway.
The incident allegedly followed a minor argument between Tyrell’s grandfather, who had been driving one vehicle, and a man driving a second car.
No facts were read in court today.
Brown’s lawyer Ian Macfarlane sought and was granted a five-week adjournment so the new charge could be discussed with his client.
The matter is set to come before the Supreme Court for mention on May 6.
Mr Macfarlane told Magistrate Peter Malone there would be no application for bail made in the higher court.
As Brown was being led from the court, members of Tyrell’s family, including his father Nathan, screamed abuse at Brown.
Other family members broke down in tears while additional security staff brought in for Brown’s appearance set up a human barrier between the dock and the public gallery.
Outside the court, Tyrell’s grandfather Eddie Barron-Ugle said Tyrell had yet to be buried.
“We lost our grandson. What can we do,” he said.

I think what Sauron is getting at is that you have to intend to kill someone for it to be murder… even if it is a spur of the moment thing. Doing something dumb (out of anger or perhaps drunk driving) the charge is usually involuntary manslaughter though if it can be proved that you knew you were risking the lives of others and took no precautions or changed your actions to prevent it (ie everytime you get drunk you always drive home and one day you drive home drunk and kill someone then you might have a case for a weak form of murder in that it was likely you were going to kill someone even if it was only yourself).

It doesn’t matter whether it was premeditated or not, an innocent child has lost his life all over a minor road infringement
Give the bas*ard the maximum penalty and maybe it’ll act as a deterrent to other short tempered morons out there

I don’t know Australian laws but I imagine that his defence will argue that the act was not premeditated and he will serve a somewhat watered down murder charge involving early parole. Is there someone here who knows?
