er, Geforce…
You forgot two options:
3. The Iraqis were not able to use them, due to speady advance, Coalitions tactics etc.
4. Iraqi soldiers decided not to use them, as they know who was gonna lose, and they decided they’d rather live.
The terms of the Geneva Convention state that a prisoner only has to state his name, rank and number. If the American prisoners wish to say more under interview then that is a matter of conscience for them.
But the point is, that these prisoners cannot form their own free will. They have just been captured, are disorientated, have been shot at etc. There is no way in hell that under these circumstances they can freely form their own opinion. This treatment is a violation of international law.
As for all these accusations of double standards: they are irrelevant. Even if one party does not abide by the Geneva Conventions the other side is still obliged to follow the rules layed down in the Conventions.

Garry makes a good point. Does it have to a war officially before the GC has any hold?
No, according to article 2 of the Geneva Conventions it does not officially have to be declared a war.

Sorry to interrupt
but why would the Geneva Conventions not have any legal meaning here?

That would be a unilateral act against international law, Geforce. Surely you don’t want to be responsible for that… I guess you should go to the UN Security Council first, trying to settle this in a peaceful manner.

second There may be many other nations with Chemical weapons but you name me one that has used them in the last 50 years?
I can name one, besides Iraq of course. Don’t know if that’s a good thing though.
