There are a number of emerging ultra low-wage economies in the ex-Soviet republics to the north-west of India that could very well bring Damien’s words home to Sameer – and sooner rather than later.

If a moderator or other person in authority freely gives access to the moderator forum to a user (whether intentionally or not), no breach of the Act has occurred.

You would be correct in this Damien – but only if the person involved could reasonably claim that they did not know that they had no right to access said information.

The post is called the Information Commissioner since the advent of the Freedom Of Information Act 2000, Damien, and the role has teeth these days – we’re talking personal criminal liability for individual accountable managers responsible for the type of breaches that you mention.
